Declaration of Liability

Belmot Oldtimer Grand Prix Trackday — please read carefully

Principle

The participants (applicant, coach, driver and passengers, vehicle keeper and/or vehicle owners) take part in the Trackday of the 52. Belmot Oldtimer Grand Prix 2025 (hereinafter referred to as the event) at their own request and risk. They bear sole civil and criminal responsibility for all damage caused by them or by the vehicle they use unless an exclusion of liability is agreed.

Waiver of liability

By submitting this declaration, the participants (entrant, coach, driver and co-driver, at the same time as vehicle owner and/or keeper) declare to waive claims of any kind for damages caused in connection with the respective event, in particular against:

• the FIA, the DMSB and its member organisations, the DMS Wirtschaftsdienst GmbH, their respective presidents, organs, managing directors and secretaries-general, • the AvD e.V. and the companies belonging to its network (in particular the AvD-Oldtimer-Grand-Prix GmbH and Co OHG, AvD Wirtschaftsdienst GmbH and AvD Beteiligungs GmbH), their respective presidents, executive bodies, managing directors and secretaries general, • the organizer, the sports control room, the promoter/series coordinator, the company Bratke Exclusive Cars - Motorsport GmbH & Co. KG and their managing directors or vicarious agents, the training personnel commissioned for the Track Day, the track owners/track operators, • authorities, race services and all other persons connected with the organisation of the event, • the road construction load carrier, insofar as damage is caused by the condition of the roads / squares / tracks to be used at the event, including accessories, • the vicarious agents and assistants of all persons and bodies mentioned above, • the other participants (competitors, drivers and passengers, vehicle owners and keepers) and their assistants, • subject to any other special agreements between competitor(s), driver(s) and passenger(s) against their own competitor(s), driver(s), passenger(s) and their own assistants.

Exclusions from the waiver

Excluded from this waiver are damages resulting from injury to life, body or health, which are based on an intentional or grossly negligent breach of duty – also by a legal representative or vicarious agent of the group of persons released from liability – and other damages, which are based on an intentional or grossly negligent breach of duty – also by a legal representative or vicarious agent of the group of persons released from liability.

Scope

The waiver of liability applies to all claims on any legal grounds, in particular both for claims for damages arising from contractual and non-contractual liability and also for claims in tort. Implicit liability exclusions remain unaffected by the above waiver. The exclusion of liability becomes effective for all parties involved upon submission of the entry.

Medical confidentiality

In the event of an injury occurring or ascertained in the course of the event, or in the event of damage to health that could jeopardize the fitness for motor sports permanently or temporarily, the undersigned releases all attending physicians – in view of the safety risk that may possibly result for third parties – from the medical confidentiality obligation vis-à-vis the officials working in a responsible position during the event (race doctor, race director, sports commissioners).

Insurance

By submitting the entry, the applicant/driver/co-driver acknowledges that insurance cover under the motor vehicle insurance policy (third-party motor vehicle liability, comprehensive and passenger accident insurance) for damage during the event may not be granted. He undertakes to also inform the owner and/or keeper of the vehicle used. Each participant is liable for any damage caused by him/herself; this applies in particular if non-approved vehicles are used for participation in the trackday.

Notice & image rights

The Trackday is not intended to achieve top speeds! Trackday participants hereby give their consent to the creation of video and image recordings of their persons and their vehicle during the OGP Trackday event and to the use and publication of such images for the purpose of public reporting on this event.
